Yorkshire Terrier & Biewer Terrier Breeder — Puppy Sale Agreement
This contract is entered into between Prestigious Pups (Breeder) and the Buyer. By purchasing a puppy from Prestigious Pups, the Buyer agrees to all terms and conditions set forth in this contract. This contract is legally binding and is intended to ensure the health, safety, and well-being of the puppy.
The purchase price of the puppy is agreed upon at the time of sale. A non-refundable deposit is required to hold a puppy. The remaining balance is due in full prior to or at the time of pickup. Accepted forms of payment include cash, Zelle, Venmo, or CashApp. Personal checks are not accepted. Failure to pay the remaining balance by the agreed-upon date will result in forfeiture of the deposit and the puppy will be made available to another buyer.
Prestigious Pups guarantees that the puppy is in good health at the time of sale. The puppy has been examined by a licensed veterinarian and has received age-appropriate vaccinations and deworming treatments. The Buyer agrees to take the puppy to a licensed veterinarian within 72 hours of purchase for a health examination. If the veterinarian finds the puppy to be in poor health due to a pre-existing condition, the Buyer must notify the Breeder in writing within 72 hours of the vet visit. Failure to have the puppy examined within 72 hours voids this health guarantee. Please note: The Breeder does not guarantee against coccidia or giardia. These are very common conditions in puppies due to the stress of changing homes and families and are not considered a pre-existing illness. Both conditions are easily treatable by a licensed veterinarian.
Prestigious Pups provides a one (1) year genetic health guarantee against life-threatening hereditary or congenital defects. If a licensed veterinarian diagnoses the puppy with a life-threatening hereditary or congenital defect within one year of the date of purchase, the Breeder will replace the puppy with one of equal value when one becomes available, or offer a partial refund at the Breeder's discretion. This guarantee does not cover hypoglycemia, luxating patella, undescended testicles, umbilical hernias, or any condition caused by the Buyer's negligence. Veterinary documentation must be provided. The puppy does not need to be returned for a replacement.
The puppy has received age-appropriate vaccinations and deworming treatments prior to sale. The Buyer agrees to continue all recommended vaccinations and veterinary care as directed by their veterinarian. The Buyer agrees to keep the puppy on a regular schedule of veterinary care including annual wellness exams, vaccinations, heartworm prevention, and flea and tick prevention. Failure to provide proper veterinary care voids all guarantees.
Unless otherwise agreed upon in writing, the puppy is sold as a pet only and must be spayed or neutered by the age of twelve (12) months. The Buyer agrees not to breed this puppy without prior written consent from the Breeder. Breeding rights, if granted, will be outlined in a separate written agreement. Violation of this clause voids all guarantees and the Buyer may be held liable for damages.
Prestigious Pups does not offer refunds. If at any time the Buyer is unable to keep the puppy, the Buyer agrees to contact the Breeder first before surrendering the puppy to a shelter or rehoming to another party. The Breeder reserves the right of first refusal to take the puppy back. The Buyer agrees never to surrender this puppy to a rescue organization, animal shelter, or pet store. Violation of this clause will result in legal action.
The Buyer agrees to provide the puppy with a safe, loving, and clean living environment. The puppy must be kept as an indoor companion animal and must not be kept outside or in a kennel as a primary living arrangement. The Buyer agrees to provide adequate food, fresh water, shelter, exercise, and socialization. The Buyer agrees not to use the puppy for any form of animal fighting or abuse. Any evidence of neglect or abuse will result in the Breeder reclaiming the puppy without refund.
Small breed puppies are susceptible to hypoglycemia (low blood sugar), which can be life-threatening if not treated promptly. The Buyer acknowledges that they have been informed of the risks of hypoglycemia and agrees to monitor the puppy closely, especially during the first few weeks. The Buyer agrees to feed the puppy small, frequent meals and to keep Nutri-Cal or Karo syrup on hand at all times. Hypoglycemia is not covered under the health guarantee as it is a manageable condition with proper care.
The Breeder's liability under this contract shall not exceed the original purchase price of the puppy. The Breeder is not responsible for any veterinary costs incurred by the Buyer. The Breeder is not liable for any injuries, damages, or losses caused by the puppy. The Buyer assumes full responsibility for the puppy upon taking possession.
This contract constitutes the entire agreement between the Breeder and the Buyer and supersedes all prior negotiations, representations, or agreements. Any modifications to this contract must be made in writing and signed by both parties. This contract shall be governed by the laws of the state in which the Breeder resides. If any provision of this contract is found to be unenforceable, the remaining provisions shall remain in full force and effect.
By signing below, both parties agree to all terms and conditions set forth in this contract.
